How to Qualify
for Bonus Depreciation
On a purchased Aircraft Position.
The emergence of the very light jet market has added a
new vibrancy to the secondary market for trading of aircraft purchase
contracts. These purchase contracts often originate between a purchaser and
a manufacturer with only a conceptual design and flexible specifications.
The time between execution of the purchase agreement and ultimate delivery
is often a matter of four to five years, and they frequently require
material modifications to the underlying contract.
The 2008 Economic Stimulus Act contained a provision providing for 50%
bonus depreciation on new aircraft purchases. This provision extends to all
new aircraft purchases in 2008, as well as certain aircraft contracted for
in 2008, and delivered in 2009. Naturally, there are certain limitations
including a requirement that the contract be entered into in 2008, and that
the aircraft be used more than 50% for qualified business use.
